How Parents Can Keep Access to Medical Information After Age 18

At 18, a parent usually stops being the automatic personal representative under HIPAA. Ask the young adult to sign provider-specific releases and portal permissions, and consider a Florida health-care surrogate designation when appropriate.
What to have in front of you
- The notice, bill, decision, or discharge paperwork connected to the problem
- The person’s full name, date of birth, address, insurance information, and identification
- A short timeline with dates, names, phone calls, and what changed
- Copies of medical, school, financial, or care records that directly support the request
What to say when someone answers
“The patient is turning 18 and wants me involved. Which authorization, portal-proxy, communication, and health-care surrogate forms does your office require?”
Small but useful: Write down the person’s name, the date, the exact next step, and when you should call again.
Do this in order

Ask each doctor, hospital, therapist, pharmacy, and insurer for its release and proxy-access forms.

Have the young adult choose what may be shared, with whom, for how long, and whether the authorization may be revoked.

Complete a Florida designation of health-care surrogate if the young adult understands and wants that support.

Carry copies and confirm that the authorization is visible in each electronic record and patient portal.
What happens next
Providers may grant proxy access or communicate within the signed authorization. Emergency and incapacity rules are narrower than ongoing permission.
If they say “we’ll put you on the list”
If a provider says “HIPAA” without reviewing the signed form, ask for the privacy officer and a written explanation of what is missing.
