How to Apply for Guardian Advocacy in Brevard County

Guardian advocacy is a court process for some adults with developmental disabilities. Review less restrictive options first, then use the current 18th Judicial Circuit instructions and clerk forms rather than an old online packet.
What to have in front of you
- The notice, bill, decision, or discharge paperwork connected to the problem
- The person’s full name, date of birth, address, insurance information, and identification
- A short timeline with dates, names, phone calls, and what changed
- Copies of medical, school, financial, or care records that directly support the request
What to say when someone answers
“I need the current Brevard guardian-advocacy filing packet, required reports, filing location, fees or waivers, and information about appointment of counsel.”
Small but useful: Write down the person’s name, the date, the exact next step, and when you should call again.
Do this in order

Review whether the statutory developmental-disability definition and guardian-advocacy process fit the person.

Document why supported decision-making, releases, surrogate designation, or power of attorney are not enough for the specific decisions.

Complete the current petition, medical or professional reports, education requirements, background steps, and filing requirements.

Attend the hearing and ask the order to preserve every right the person can exercise with support.
What happens next
The court appoints counsel for the person, reviews evidence and alternatives, and decides which rights—if any—are delegated. Ongoing reports or education may be required.
